Is THCA Legal in Alabama?

A buyer's guide to how Alabama treats hemp, written by people who sell it for a living. One thing before anything else: we're not lawyers and this is not legal advice. It's how we understand the rules we operate under, in plain English, with a link to the actual law so you can read it yourself.

The federal starting point

The 2018 Farm Bill legalized hemp nationwide. Federally, hemp means cannabis containing no more than 0.3 percent delta-9 THC by dry weight, and products derived from it. That's the foundation the entire legal hemp industry sits on, in Alabama and everywhere else.

What Alabama adds on top

States get to regulate how hemp products are actually sold, and Alabama does. In 2025 the state passed House Bill 445, a law that rewrote the rules for consumable hemp products, with pieces phasing in through January 2026. In broad strokes, the current landscape includes:

• 21 and up. Hemp products with psychoactive cannabinoids are adult products in Alabama. Expect ID checks.
• Licensing. Selling consumable hemp in Alabama now involves state licensing and oversight.
• Testing and labeling rules. Products are expected to be tested and labeled accurately.
• A ban on synthetic cannabinoids. Lab-invented compounds are out. Naturally derived hemp cannabinoids are what's left, which is all we ever sold anyway.
• Restrictions on certain product types and sales channels. The law drew lines around specific product categories and how they can be sold.

We're intentionally not paraphrasing the statute line by line. Summaries drift, and this area of law has moved fast and been argued over in court. What this means when you're buying

• Buy from sellers who act like it's regulated. Age checks, lab reports, real labels. If a shop treats those as optional, its products probably deserve the same confidence.
• Ask for the COA. A compliant seller can show you a third-party lab report for the exact batch you're holding. Here's how to read one.
